Circuit Judge Paul E Vardeman ordered a pre-sentence investigation in the case of a 14 year-old, Durant, who murdered Garcia, a Mexican National, who was defending his English teacher from Durant and five other youths who stole her purse. Garcia was shot 3 times by Durant and died two weeks later.

Judge Paul E Vardeman of Jackson County Circuit Court sentenced 15 year-old Durant to 25-years in prison for the second-degree murder of 23 year-old Mexican Immigrant, Garcia, last November who was defending his night school teacher where he was studying prior to applying for citizenship. 18 year-old Rowden who furnished the gun to Durant was sentenced to 10-years in prison for manslaughter. One youth was acquitted, charges were dropped for two youths and the sixth youth was turned over to juvenile authorities.
